You Have the Right to Consult With a Lawyer While in ICE Detention
Although you may not be a US citizen, you still have the right to meet with your deportation defense lawyer while detained by ICE. In fact, you can request a meeting with a lawyer at any stage during your arrest or detention. Most lawyers recommend that you remain silent until you have a chance to speak with a lawyer. It is all too easy to say the wrong things during this process, and your comments could be self-incriminating.
That said, the government has no obligation to provide you with a lawyer. This is an important point, since criminals usually get free representation in the form of public defenders. ICE detainees do not have a right to a public defender, so you’ll need to organize your own legal defense and hire a lawyer.
ICE should give you the right to make a private phone call after your detention. You may ask for a list of lawyers in your area, or you can search for a lawyer using a tablet, phone, or computer.

Once you team up with a lawyer, they can locate you using the Online Detainee Locator System provided by ICE. This system allows your lawyer to meet with you even if ICE relocates you to a different facility or location.
ICE also has a “virtual attorney visitation program.” As its name suggests, this program allows you to meet with a lawyer virtually while in ICE custody. According to the ICE website, however, this program is only available in “some” detention facilities. Virtual meetings are convenient, and they may reduce your legal fees.
Your Deportation Defense Strategy May Be Easier to Plan After Your Release
Although it is possible to organize a deportation defense strategy while remaining in ICE custody, this process will be easier once you secure release. If possible, talk to your lawyer about submitting bond or parole requests.
