US Government Cracks Down on “Public Charges” While Simultaneously Increasing Fees for Immigrants

New Public Charge Rule Goes Into Effect

On July 21st, 2026, the American Immigration Council reported that the US had implemented a new public charge rule. The new rule gives immigration authorities broad discretion to deny green cards and other visas if applicants are likely to become “public charges” (dependent on the state) in the future.

The vagueness of this new rule is effectively what gives it so much power. By not specifically spelling out how it defines “public charges,” the administration theoretically has the ability to classify virtually anyone as a potential public charge in the future. Many immigrants have stopped using benefits because they fear the consequences of this new rule.

The logic behind this change is simple: The government believes that the American taxpayer should not have to carry the burden of a new immigrant who immediately goes on benefits after gaining lawful entry. One might argue that this makes sense, but other new moves by the government seem to contradict this logic.

Other Changes Could Bankrupt Immigrants

If the government is concerned about immigrants becoming public charges, then why is it increasing financial pressures and making these immigrants more likely to go on benefits? A federal judge recently blocked an effort by the administration to revoke work permits for asylum seekers and those with temporary protected status (TPS) unless they pay new annual fees. By preventing immigrants from working while enforcing new fees, the administration is making these individuals much more likely to turn to government programs.

Another proposed change would create a $100,000 bond for all green card applicants. These individuals might subsequently arrive in the United States heavily in debt, having liquidated all their assets to pay the bonds. This also increases the chances of an immigrant becoming a public charge.

The Trump Gold Card visa seems to put another high price tag on citizenship. Some might sell virtually all their assets to get their hands on one of these gold cards, arriving in the United States with nothing to their name before quickly becoming a public charge.
