Immigration Officials Criticize Post-Study Immigration Program as Government Terminates “Duration of Status”

One of the most popular immigration programs for foreign students in the United States is Optional Practical Training (OPT). This program allows students to remain in the country for up to two years after graduating from US colleges while retaining their F-1 status. ICE director Todd Lyons says that over 10,000 students may have been fraudulently taking advantage of OPT.

The director states that many of these students remain in the country to scam elderly individuals, carry out intellectual property theft, make biological threats, and spy for foreign nations. When it was first conceived, the program was supposed to prioritize the most promising young candidates and secure them for American interests.

However, there are growing concerns among some immigration observers that OPT has spiraled out of control. No longer prioritizing the best and the brightest, this program now allows hundreds of thousands of people to work in the United States, or so the critics say. This comes after a surge of over 20 percent in OPT participation during the 2024/2025 school year. This surge represents almost 300,000 people, half of whom are Indian.

One concern is that fraudulent companies are charging students for fake evidence of employment. The ICE director describes this as a “pay-to-stay” immigration scam, and he warned that anyone participating in this kind of fraud would face criminal and or civil consequences. Critics say that cracking down on OPT could drive down enrollment of foreign students in American colleges.

“Duration of Status” System Poised to End

Another popular aspect of student visas in the United States is something called “duration of status.” Under this policy, foreign students had the ability to remain in the country without renewing their visas, as long as their university programs ended. However, the government has indicated that it wants to end this approach, instead creating strict time limits for how long a student can stay in the country under the same visa, regardless of their program length. Critics say that this could impact students who need to study for longer than four years in the United States.
