The American Association of University Professors is suing the government over the Trump Gold Card visa, claiming that it violates the Administrative Procedure Act. The group also claims that the new green card violates the Immigration and Nationality Act.

When the administration announced this new program, it wasn’t clear whether this would be an entirely new green card category. According to Bloomberg, the Gold Card program simply uses the existing availability of EB-1 and EB-2 visas. The government normally reserves these visas for those with extraordinary ability or advanced degrees, but the gold card allows recipients to bypass these requirements with a $1 million payment.

The professors are concerned because people with money can simply cut ahead of people with legitimate abilities and educational qualifications. The argument is that these people can contribute immensely to the United States, whereas someone with $1 million may not offer much in comparison.

It’s no surprise that a group of university professors is filing this lawsuit, and one of the plaintiffs is a researcher who was reportedly denied a visa specifically because of the arrival of the Gold Card.
